Rexburg Business License: Annual Registration, Health Clearance and the BYU-Idaho Market
Rexburg Business License: Annual Registration, Health Clearance and the BYU-Idaho Market
Idaho does not issue a state business license. Registering your business with the Secretary of State is a registration, not a license, and counties do not issue a general business license either. Rexburg is where the local details start. The city requires an annual business registration for businesses that include professional services, and certain activities carry their own health, police or city council requirements. This guide covers how to work out which of those apply to you, what to file, and what to watch for if your customers are BYU-Idaho students.
This article is general information, not legal or tax advice. Confirm every requirement with the agency named below, and talk to an attorney or CPA if your situation is complex.
Materials and information to gather
- Your structure decision: sole proprietorship, LLC or corporation.
- Your legal name and any different trade name you plan to use. A different trade name requires an assumed business name (DBA).
- An Idaho registered agent with a physical Idaho street address. P.O. boxes are not accepted.
- Your Rexburg business address and a plain-language list of the services or products you will sell.
- Any professional, trade or board credentials that apply to your work.
- A federal employer identification number (EIN), which you can request directly from the IRS at no charge.
- A payment method for Secretary of State and City Hall fees. Ask City Hall which payment types it accepts.
Step 1: Call City Hall before you file anything
Rexburg's requirements depend on what you do, so start with the City Clerk at City Hall, 208-359-3020. Ask four questions: Does my activity need the annual business registration? Does it need health clearance? Does it need a police registration or a city council license? When is my renewal due?
The last question matters because the city's own pages disagree. Some say renewals are due in January, and another page says most renewals are due December 31. Get the current due date confirmed by the Clerk, and write down the name of the person who gave it to you.
Step 2: Sort your activity into a category
Rexburg's code and city summaries point to several separate tracks. Find yours before you pay any fee.
| Activity | Requirement | What to confirm |
|---|---|---|
| Professional services | Annual business registration with the City Clerk | Current renewal due date and registration form |
| Vendors, solicitors and temporary merchants | Health district requirements must be satisfied before a registration issues | Which health district rules apply to what you sell |
| Towing and parking enforcement | City license plus police registration | Application steps, fees and any inspections |
| Alcohol | City council license plus Madison County and state licenses | The order of approvals and which agency issues first |
| Contractors | No statewide general contractor license. Register with the Idaho Contractors Board at DOPL | Board registration for your trade, plus any City Hall requirement |
Step 3: File your entity or assumed business name with the Secretary of State
File through SOSBiz at sosbiz.idaho.gov/forms/business, and check the Secretary of State's general information at sos.idaho.gov.
LLC. The Certificate of Organization (Limited Liability Company) costs $100 online or $120 on paper. The name must contain the phrase limited liability company, limited company, LLC, L.L.C., LC or L.C. Limited may be abbreviated Ltd., and company may be abbreviated Co. The name must be distinguishable from existing, reserved and registered names on Secretary of State records, so search first at sosbiz.idaho.gov/search/business. The name also cannot falsely imply government affiliation.
Standard processing is approximately 7 to 10 days from filing. Expedited options carry a $40 surcharge for evidence of filing within 8 working hours, or a $100 surcharge for same day service on filings submitted before 1:00 p.m. Mountain time.
DBA. The Idaho assumed business name, called the Certificate of Assumed Business Name, is filed with the Idaho Secretary of State, not the county. It costs $25 online or $45 on paper, and the paper fee includes a $20 manual data entry surcharge. It does not renew and stays active until you cancel it. A name reservation for 120 days costs $20.
Step 4: Appoint an Idaho registered agent
Every entity must continuously maintain a registered agent in Idaho. The agent needs a physical Idaho street address and must be available during normal business hours. The agent can be an Idaho resident, an Idaho-authorized business entity or a commercial registered agent. An owner can serve as their own agent if they use an Idaho address. A DBA cannot serve as a registered agent. Commercial agent prices vary, so compare them and confirm the cost before you sign up.
Step 5: Set up your tax registrations
Idaho's state sales tax rate is 6%. If you sell taxable goods, apply for a sales tax permit at tax.idaho.gov/ibr. Local sales tax applies only in voter-approved resort cities, so confirm with the Idaho State Tax Commission at tax.idaho.gov that none applies to your Rexburg location.
For income tax, Idaho uses a flat rate, which was 5.3% for 2025. Confirm the current year's rate with the Tax Commission. A default LLC is a pass-through entity, so members report Idaho income on their personal returns. An LLC that files a partnership or S corporation return owes the $10 permanent building fund tax. An LLC taxed as a C corporation pays the 5.3% business income tax plus the $10 permanent building fund tax. Your CPA should choose the structure and tax election with you.
Step 6: Clear health requirements if they apply
City Code 6.01.020 says vendors, solicitors and temporary merchants must satisfy health district requirements before a registration issues. The code still names the District Seven Health Department, whose successor is Eastern Idaho Public Health. Ask the district directly what applies to your business.
Bring a written description of what you sell, how you prepare or handle it, and whether you operate from a fixed location or a temporary one. Ask for written confirmation of what the district requires and what documentation it issues. Do not assume a service business is exempt, and do not assume a mobile or pop-up seller is covered without asking.
Step 7: Handle activity-specific licensing
Towing and parking-enforcement firms need a city license plus police registration. Alcohol sales need a city council license plus Madison County and state licenses. Confirm the sequence of those approvals with the Clerk before you apply.
Short-term rentals have a recent change. Since July 1, 2026, no city or county may require a license, fee, permit or registration for a short-term rental under HB 583. State and local lodging taxes still apply, so confirm your lodging tax obligations with the Tax Commission and the city.
Step 8: Submit your Rexburg registration
Bring your Secretary of State filing confirmation, your DBA certificate if you use one, any health district documentation and your written activity description. Ask the Clerk for the current registration form and fee. This article does not list the city fee, so confirm the amount with City Hall before you bring payment.
Step 9: Calendar your recurring deadlines
- LLC annual report: required every year, due before the end of the month in which the Certificate of Organization became effective, beginning one year after formation. Idaho Code 30-21-214(b)(7) lists the fee as no fee.
- Corporation annual report: the same schedule applies to Articles of Incorporation, with no fee.
- Rexburg renewal: confirm whether your due date is January or December 31.
- DBA: no renewal, but it stays active until canceled.
- Tax filings: schedule your sales tax and income tax filings with your CPA.
The BYU-Idaho student market
Rexburg's small business activity is closely tied to the university. Many local businesses serve students with tutoring, photography, lawn and snow work, rentals, food, apparel and delivery. A few points matter for those businesses.
- Student side businesses are often sole proprietorships. Operating under any name other than your own requires a DBA. Once revenue becomes steady, ask a CPA whether an LLC makes sense.
- Whether a side business needs Rexburg's annual registration depends on the activity category, not on the owner's student status. Ask the Clerk.
- Selling at campus events, markets or pop-up tables can bring in temporary merchant and health district rules. Ask the event organizer and the health district before you set up.
- Sales of taxable goods to students are still subject to Idaho's 6% state sales tax.
- Ask the university whether it has its own rules for vendors, events or student-run sales. This article does not cover them.
- Demand often follows the academic calendar, so plan registrations and renewals around semester starts instead of a deadline week.
Common mistakes to avoid
- Searching for a state business license. Idaho has none for general business. You register instead.
- Filing a DBA with the county. The Idaho DBA goes to the Secretary of State.
- Assuming an LLC filing also satisfies Rexburg. The Secretary of State filing does not replace the city registration.
- Using a P.O. box as your registered agent address.
- Choosing a renewal date from one city page without confirming it with the Clerk.
- Assuming health clearance applies only to restaurants. Vendors, solicitors and temporary merchants face health district requirements too.
- Skipping the annual report because the fee is zero. It is required every year.
- Assuming a short-term rental needs a city permit. Cities and counties cannot require one since July 1, 2026, but lodging taxes still apply.
What to expect
Most of the early work happens in Steps 1 and 2, because the category you land in determines everything after it. Once the Secretary of State filing is submitted, you may expect standard processing to take approximately 7 to 10 days, or less if you pay for expedited service. Health clearance and activity-specific licenses may take longer, and each agency sets its own timeline. Confirm those timelines in writing before you commit to a launch date.
When to get professional help
Consult an attorney about entity structure, liability questions and any alcohol, towing or contractor matter. Consult a CPA about pass-through reporting, tax elections and sales tax registration.
